Hi Entra,

Nice to be remembered. Actually there is a lot going on in my life right now. I moved to Toronto (from California) a couple of weeks ago. Just started a jew mob....oops...I mean a new job so busy with that. Buying a car, getting insurance, finding a place to life, getting to know the locality etc. It's indeed quite hectic.

Not to mean that I dont visit PakPassion anymore. I do, almost everyday infact. But at the end of the day I just dont have the energy to post. Will just browse through the listings.

sorry first time i read this i think... anyhow a woman can ask for divorce from her husband and if he is unwiling to do it , she can have the elders/imam/committe/village elders issue an edict/fatwa to ask teh husband to give divorce.

That's my limited understanding that women have a right to ask for it but obvioulsy cannot divorce the man as we men can divorse them.

lets say the couple agrees to have the condition in the marriage contract that the woman can divorce the same as man, would that be binding and acceptable?

secondly, what is the way to give divorce for the man? just say it 3 times and thats it? or does there have to be time between the 3?

first point: a woman can have that in the contract but islamically if she wants a divorce husband has to do the bit and he should be held to oblige the contract as any other comntract a muslim undertakes. The two things are unrelated in itself.

second point.

divorce can be given immediately X three or can be given over time however each pronounciation is binding i.e I say divorce once and then wait 11 years to say it again, the count is two even though I may have said it in anger, not one. That's as fine as I go into divorce law, I mean if both partners agree then let's get it over and if the man is an idiot then and likes to theraten divorce then he deserves it because the only way he can anull the divorce is for his ex wife to be married again to another man with the conjugel rights being met and divorced again.
