    Supreme court quashes case against MD Dhoni [Update Post #119]

    Anantapur (Andhra Pradesh), Jan 8: India's limited overs captain Mahendra Singh Dhoni was today (January 8) issued a non-bailable warrant by a court here with regard to his photo as God Vishnu on a magazine cover.

    According to reports on Friday (January 8), a non-bailable warrant was issued against the Indian skipper by a court in Anantapur and has been asked to appear in person on February 25. Dhoni is currently in Australia to play 5 ODIs and 3 T20Is against the hosts, from January 12. The tour ends on January 31.

    In the April 2013 edition of "Business Today" magazine, Dhoni's face was morphed as God Vishnu on the cover page with the title "God of big deals". For this, cases were filed against the cricketer for "denigrating" Hindu God. In August 2015, the Karnataka High Court, after taking up the case, had observed: "A celebrity and a cricketer like Dhoni should know the consequences of hurting religious sentiments of people. He should have known the consequences of doing such ads."

    In his defence, Dhoni had said he did not pose as God. "I haven't received any remuneration/goodwill or money for the news article or for usage of my picture on the cover page or anywhere else. Neither have I posed for the picture which was published in the magazine on April 14, 2013," the captain had said. In September 2015, the Supreme Court had stayed criminal proceedings against Dhoni in the same case where he was alleged to have deliberately hurt religious sentiments by posing as God Vishnu.

    Posing as Lord Ram, Lord Krishna is all part of our culture.

    Kids do that ALL THE FREAKING TIME.

    Posing as Vishnu isn't even violation of sentiments. As usual some jobless people are kicking up a storm over nothing.

    Worst part is this isn't anyway related to Dhoni cos he didn't even officially pose for it.

    I hope Supreme Court reads the riot act to the sessions judge and suspends him.

    Do we sue all those stage actors who participate in Ramleela during Vijayadashmi depicting themselves as Gods?

    This does not make sense at all. Firstly, Dhoni never posed as a God, just his picture was used by the magazine, secondly how is it hurting religious sentiments is beyond me.

    At the worst, the magazine should be sued, not Dhoni.

    iirc, the issue was not about him posing as Lord Vishnu. The issue was in that pic, he would be having some 10 arms, in one of which, he would be seen holding a shoe. That made all the issue.

    Court issues Non-bailable warrant against Indian captain Mahendra Singh Dhoni

    New Delhi: A non-bailable warrant has been issued against Indian skipper MS Dhoni by a court in Anantapur in connection with him appearing on the cover of a magazine as Lord Vishnu.

    The 34-year-old has been asked to be present in court on 25 February.

    The legendary skipper was in hot water in 2013 for appearing in an advertisement on the cover of Business Today as Lord Vishnu holding a number of things.

    The ad prompted social activist Jayakumar Hiremath to file a case to register a complaint against him, with a case being registered against him under section 295 and 34 of the Indian Penal Code (IPC).

    In reply, the High Court had said, "These celebrities are only signing ads without any responsibility. Their aim is to earn easy money without considering the problems it may create."

    Taking cognisance of the complaint filed by Hiremath, the Additional Chief Metropolitan Magistrate (ACMM) had registered a case against Dhoni under section 295 (injuring or defiling place of worship with intent to insult the religion of any class) along with 34 of the IPC.

    Later, the ACMM had issued summons to Dhoni to appear before the court, which he did not and instead moved the High Court against its direction.

    But still.....too much made about nothing where the point of the message was clear. But then people can use some technicality in law to file a case.

    However its a surprise how Dhoni got entangled in this issue (instead of the magazine) when he didn't pose for it.

    That would've been offensive to a few orthodox religious people. The magazine should have known better.

    I don't know whether Dhoni posed for it or not, but anyway people file cases only against the big shots so that they can milk more money.

    No. First, his appearance is directed on 25 Feb.

    Second, even otherwise this is not an extradition offense since a requirement for extradition is that the act has to be offense in both countries.

    Third, despite the name, non-bailable warrant doesn't mean you can't get bail. It just means that bail is not automatically guaranteed as a matter of right. Whatever the case, of course Dhoni will get bail.

    Non-bailable doesn't mean you can't get bail (see my above comment).

    Yes we had few bad last couple of series there. But dnt forget we beat them and won the commonwealth bank ODI series there in 2008. That aussie team had stars like Gilchrist, Lee, Ponting, Hussey, Clarke etc.

    Sure we can beat them again.

    No hate from Indians in general.

    Only Indians on this forum.

    There is a subsection of the Indian fan-base that is classist and will never forgive Dhoni for being a small town boy.

    There is a subsection of fans who are rabid about Test match and hate that Dhoni prefers IPL, T20 and ODIs to their sacred format.

    Neither your points or mine matters in this case. What matters is the law of the land. I dont care about your definition of blasphemy. I am just happy that the matter has gone to court and I am interested in how justice is served.

    There are three type of people in the thread:

    1) The sane ones - Asking for the magazine to be sued but not Dhoni if it actually hurt religious sentiments. Dhoni does not needs to apologize in any case. It is not his doing.

    2) The point scorers - Using words like religion is the bane of humanity. What has religion itself to do with what its followers are doing? If someone does anything wrong in the name of the religion that should not implicate the religion.

    3) The insane ones - Dhoni should be tried under blasphemy law because by not denying or apologizing he is a partner in this crime.
