Burden of proof becomes sticking point in Panama case

ISLAMABAD: Members of the Supreme Court bench hearing the Panamagate case on Friday expressed divergent opinions over which side shouldered the burden of proof. While Justice Asif Saeed Khosa — who heads the five-judge bench — wanted the onus to prove innocence to rest on Prime Minister Nawaz Sharif’s family, two other members of the bench differed

It really is pathetic seeing Maryam deny the part of Panama papers that proves she's a beneficial owner while acknowledging the rest of the leak as genuine.

So, you see a thief stealing. You go to the police but the judge, instead of telling the police, tells you (a normal citizen) to bring proof of the crime committed by the thief.

Absolutely ridiculous and what has happened in this case. I guess good of our courts to admit that NAB and the other organisations are useless.

Besides the humiliation of the Sharifs in the eyes of people who care for PK, nothing will come it. The SC is corrupt and they will give a fudged verdict which means nothing.

The issue was about the flats purchased by Nawaz in London, well the issue more was where did the money come from? The Panama papers showed off-shore companies, under the name of Nawaz's children and the said companies were apparently involved in purchasing property. However at the time the properties were bought the children were in their late-teens to 22 year old hence would not have had the ability to buy the properties, which meant the cash came from their father who was the PM at the time. Nawaz then made a speech to the country explaining he had got the funds from an xyz source (I forgot which, lets call it source A). But after the media and his opponents dug into that story it was clearly false. So in the Parliament he gave another story that he got the funds from the proceeds of a sale of a factory in Jeddah. This again however after media speculation and more documents and evidence was proved to be a complete lie. What is interesting is that when he was making this speech in the parliament, he handed over his speaker some documents as proof of his story re: Jeddah, what those documents were is unknown, as they couldn't have been anything legitimate because in the actual court he changed his story for the THIRD time, claiming via a letter from a Qatari prince, that the funds came from said prince's family. This again, however, has proved to be false. As the said prince would have been 2 year old or a mere toddler at the time when his family gave the Sharif's money and hence his young age meant anything he ''heard'' was mere hearsay and couldn't actually prove any sort of money trail. (We will come back to the money trail later)

In addition to the above, the children's stories contradict with each other and their father's who himself has given three different versions, about where the actual funds came from to purchase the property. Sometimes the children say their father sent them money as pocket money, other times they say the properties were purchased in 2006, which again is a lie. This is not even taking into account the statements of atleast 4 ministers who have said, live on television, that the properties were purchased in the 90s. There was also a BBC documentary in 1999 (I think its 1999) where they highlighted major corruption by the Sharif family, keeping in mind that the documentary's contents were and have never been challenged by Nawaz. The Sharif family was also fined in a case in UK relating to their properties in UK, this fine was £34 million. They have failed, so far, to establish where this money came from.

Coming back to the money trail, the case was and is fairly simple. All Nawaz has to do is give a money-trail and give proof that his properties were paid by xyz means. Considering the obvious and suspected case of money-laundering he has not proven this yet. In the last hearing in December, his lawyer admitted that ''we cannot prove any money-trail''. You can take what message from that, if you will.

@WebGuru can add more/correct my mistakes but this is my understanding so far.

I think whatever you say in parliament comes under Parliamentary immunity.

anyway, PTI should start a media campaign and use this statement of SC to imply that NS is a liar and SC is under pressure. no loss to PTI, will put both NS and SC on back foot.

Looks like PTI is losing this case in SC as far as showing proof for Panama Leaks is concerned; PTI has failed in this regard.

But PTI may win the case in SC for PM lying in the parliament. PM did lie in the parliament; let see if SC can impeach him for lying in parliament.

Has PML N Lawyer started giving Arguments for his Client ?

Or you are deducing conclusions already ?

If I am not wrong SC will hear PML N lawyer for 1 or 2 weeks where they will try to justify Sharif's properties and prove that no money was sent from Pakistan and no offence of money laundering took place.

The SC is corrupt to the core, this case is being used to make money for the (dis)honourable judges. As I have been saying for a long time, this whole thing is a facade and besides a few pointless comments, The Nooras are free to loot.

In PK if you offer enough, 99.9% of people will accept irrespective of the catastrophic effects on the long term future of the country. We can see our great hero Gen Sharif, take the money from the Friends of the Nooras, and the SC will always bow to the power of the dollar. PTI (may) have failed to submit evidences/proofs but it does not mean that the case is over.

Case will be decided on the basis of the evidences submitted by PML N Lawyer. If the convince the court that either they bought those properties with legally earned money, tax was paid and than the money was transfered through legal channels or prove that all the properties were gifts from family friends Qatari's than PTI loses the case.

Burden of proof is on the accuser (PTI) and not the accused (PML-N). So even if PML-N lawyers fail to establish money trail beyond doubt, the verdict will be against PTI since PTI failed to provide proof beyond doubt.

SC though can catch PML-N on lying in parliament and may ask Nawaz Sharif to resign voluntarily.

I recommend your name as an Advisor for International Anti-Corruption Court which has not been established uptil now.

Atleast the biggest virtue you will do will be to save all human beings whose properties have been disclosed by Panama. All will be acquitted in 2 hearings at max.

one thing which the case has made very clear is how pathetic and unprofessional the legal industry is in pakistan. the stupidity of the people at the very top of it is astonishing. even for a layperson, the massive gaps in logic and the constant need to replace council is inexplicable.

Panamagate case: Burden of proof lies with PM's counsel, Judges say

The prime minister's counsel, as he resumed his arguments before the Supreme Court during hearing of the Panamagate case on Thursday, was quizzed about a money trail for the London flats and asked to prove there were no inconsistencies in the PM's speech in the National Assembly last year.

The PM's counsel Makhdoom Ali Khan denied that his client had anything to do with the London flats before a five-judge bench headed by Justice Asif Saeed Khosa.

Khan argued that the family business was transferred to Nawaz Sharif's son, Hussain Nawaz after the death of Mian Sharif, the PM's father. "Nawaz Sharif had nothing to do with it," he said.

"If there was no connection, then how does the money trail lead to the London flats?" Justice Khosa inquired. "There are two different money trails before us. How did the money go from Jeddah and then to London? And how did the money go from Dubai to London and then Qatar?"

The PM's counsel denied Nawaz Sharif had been a director of the family's Dubai factory.

"How can we believe that he was never the director?" Justice Khosa asked. "No documents have been submitted before us to prove he was never the director."

Khan told the bench that the Dubai factory was established after taking a loan, upon which he admonished by a judge for presenting documents in court that did not make this apparent. The counsel asked the court to form a commission "to go to Dubai and review allegations made against the prime minister."

Justice Ijazul Hassan observed that the prime minister had recognised the Dubai mills and said all records are available. "Now the burden of proof is on you," he told the PM's counsel.

Khan was of the opinion that presenting documents and proof is the petitioner's job.

Justice Khosa remarked, "the prime minister's lawyer will have to satisfy the court" regarding the ownership of the Dubai factory.

Justice Sheikh Azmat Saeed told Makhdoom Khan that the Panamagate case is based on contradictions in statements made by the prime minister on the floor of the National Assembly after the Panama leaks last year.

The judge, referring to the plaintiff's allegations that Nawaz Sharif provided incorrect statements, told the counsel, "If you disagree, then you will have to prove it."

"If there is a small mistake in the speech, it can be overlooked. But if mistakes were made on purpose, there will be serious consequences," Justice Ejaz Afzal warned.

"We do not believe that the speech was wrong but if something was hidden on purpose, we will consider that to be a half truth," Justice Khosa said.

"Will Article 66 be a hindrance to the court's review of the PM's speech?" Justice Ejaz asked.

The counsel told the judge that the prime minister, in his speech, was giving an overview of his family's business.

"He was not giving oath or answering a specific question," Khan said. "The prime minister's speech was not a statement in the court."

Makhdoom Khan said that there are two ways to remove the prime minister: the first is by the submission of a no-confidence motion. The second requires that Members of the National Assembly prove that the PM is dishonest.

"The Supreme Court, however, cannot disqualify him based on the statements and claims of others," Khan said.

"Did the prime minister tell the truth or did Hussain Nawaz tell the truth," Justice Ejaz inquired. "If one of them has told the truth, then the other has lied."

"The record the the prime minister referred to in his address has still not come forth," Justice Gulzar observed.

Justice Khosa remarked, "The prime minister had said his life is an open book. There seem to be some pages missing from that book."

Makhdoom Khan finished the days arguments by telling the court that the matter of the money trail has nothing to do with the Nawaz Sharif.

"The business belongs to the [premier's] children. The record will be presented by their lawyer."

"The lawyer of Hassan and Hussain Nawaz will present details about the business and the money trail record," Makhdoom Khan said.

The hearing was adjourned till Friday.

These judges look so confused one day they say burden of proof is on PM and his family next day burden is on PTI and the next day it's back on PM and his family shoulders.

If i am not wrong the head of this bench Justice Asif Saeed Khosa always maintained that the burden of proof is on PM and his family.

Not a single document presented by Sharifs in court today and it was a repeat of last month in court today their previous lawyers also said we don't have any money trail or docs to prove the innocence of sharif family.

Will Badsha Salamat ever be convicted of his crimes - I though this daily hearing thing would most certainly expedite the case.

It seems that these Sharif Baradaran are in no mood for cooperating with the SC

Hypothetically speaking, if the SC makes a judgement (somehow) against the Sharifs since there are glaring irregularities in their described chain of events, would Badsha Salamat step down ??

I mean even if he looses the case, I don't see a guy like NS stepping down easily

Last time he attacked SC when this happened and after that CJ Iftikhar saved him in Asghar Khan case 2012 and this time they are coming up with a new amendment in constitution so that they can ask for a review of Supreme Court verdicts. PPP is going to support this amendment.

If WebGuru is Prime Minister of Pakistan and TSPK is ICIJ who reveal documentary evidence of WebGuru's family's properties abroad, properties which were not shown to FBR, Election Commision of Pakistan by WebGuru and his Son in Law (Webguru's daughter is named as beneficial owner)

Opposition raises voice. FBR, FIA, NAB, EC do nothing.

    Opposition party turn to roads

SC takes up the issue than

    Either WebGuru has to

    1. Sue ICIJ and say these are not properties of WebGuru or his children or

    2. Admit that this Property is WebGuru's children but WebGuru did not give them the money to buy it. They themselves earned the money and bought this property. This is their earning since getting graduated. These are their Tax returns. or

    3. WebGuru should say I gave them the money to buy these properties. This was my source of income, these are my Tax returns, no money was sent from Pakistan or I earned money from my family business abroad for which these are details of tax my company paid abroad.

If WebGuru convinces the court with evidence ie present legal Money trail if Money was transferred from Pakistan.

Or present evidence of income from abroad.

Or present the details for any family in Pakistan or Abroad owning the Property previously and gifting it to WebGuru's family or giving them the money as gift to buy the Property. There would be some bank transaction involved.

If WebGuru convinces court that no corrupt practice took place while acquiring this property than the Court should give a ruling in favour of WebGuru

Than the case would go to EC to determine what to do with Concealment of Assets by Son in Law of WebGuru or WebGuru himself if before filling nomination papers after acquiring these assets abroad ie that date onwards WebGuru's daughter wasn’t showed as his dependent by WebGuru. Than EC has to give a verdict whether WebGuru concealed his properties or whether his son in law concealed ?

    That's it.

Judges have the right to ask questions aswell as give arguments. Ultimately their judgement will speak for them. So let's see after Sharif family's Lawyer completes his argument than either SC gives a judgement or they seek help from Inquiry agencies in this matter.

For PM's sake hope he provides the evidence and get his and his family's name clear.

Personally if I was in PM's position and if I was clean I would have asked FIA and FBR to conduct an inquiry with in 4 weeks the day Panama Leaks took place. For this they can inquire PM, his Wife and children. Present the Report 28 days later infront of Public of Pakistan.

It makes sense to ask clarifications from pti council about the accusations during pti council's ti e.

It seems that the SC is working super hard to find a way to let Nawaz off the hook. Mashallah kya system hai.

The whole world knows Sharif is corrupt, they themselves proved in court by not providing money trail and yet the esteemed judges still find them "innocent".

I remember that. Unbelievable how these still have supporters. And hilarious thing is, those wedontsupportNoonleaguebutwewilldefendthemeverywhe re are absent from these threads yet will bash Amir (someone who has been punished). If this was PTI I'd disown the entire party in 5 seconds and call Imran Khan a traitor. I don't know if you heard, but also reports of major rifts between the brothers. Shehbaz and Hamza have not spoken ONCE in defence of their brother/uncle recently. Even during dharna there were reports that Shehbaz's family was angry that everytime they are asked for sacrifice and Nawaz ends up PM.

You have to question our people, look at MQM. Obvious outside funding links and they STILL have support.

According to them and IK and his party should act like angels if they want to criticize Nooras otherwise we will reject them. True there are issues within family from dherna days when nawaz wanted Shehbaz ro resign and that was one of the reason Princess Maryam had to wish happy birthday to her uncle Shehbaz on social media to show look we don't have any issues everything is ok. Hamza and Maryam don't speak to each other and have their own groups within the party. Faisalabad LB elections clearly showed us Shehbaz vs Nawaz group in PMLN. Another example was NA-122 by-elections.

Some people will point out even little mistakes of IK/PTI just to cover big blunders of Nooras/Bhuttos. Those who call IK UTurn Khan are gone missing after seeing these big Noonturns in last 8 months

I don't think IK can ever match this crook's U-turns. First in the speech, then parliament and then in court.

What do you think about Shehbaz? I have heard of a Nisar group as well, which is what Nawaz is afraid off. Personally if there is a leadership change I would rather it be someone other than a Sharif. I assume Maryam's ambitions will die if Nawaz is dismissed?

Shehbaz and Hamza have not spoken ONCE in defence of their brother/uncle recently. Even during dharna there were reports that Shehbaz's family was angry that everytime they are asked for sacrifice and Nawaz ends up PM.

You have to question our people, look at MQM. Obvious outside funding links and they STILL have support.
It's quite obvious why. Nawaz is a sinking ship and Shahbaz doesn't want to go down with him. For what its worth Shahbaz is the lesser evil . Also Nawaz wanted his daughter to be positioned as the next PM, whereas Shahbaz's son (who is actually a Sharif) would have had similar aspirations.

What do you think about Shehbaz? I have heard of a Nisar group as well, which is what Nawaz is afraid off. Personally if there is a leadership change I would rather it be someone other than a Sharif. I assume Maryam's ambitions will die if Nawaz is dismissed?
Shahbaz is the lesser evil but i will have Ch Nisar as PM over all these Shareefs/Bhuttos any day of the week (although he also have a history of having soft corner for banned sectarian outfits just like Shareefs). If NS go down in this case thn Maryam will also go down because thn there is no way of her coming clean out of this case.

And here we go PMLN is back with same old card "Establishment is behind this case and they are using IK and SC against Govt".

That's what Rana Sanaullah said a couple of hours ago. Frustration of derbaris is pretty clear now.

    thanks man.

im in disbelief with this whole thing. i dont think anyone expected this to be predictable, but for it to play out in this extreme way is astonishing.

how is this government tenable with a pm claiming immunity? in a fair system there would be immediate moves for his removal within legislations, or legislation moved to close the loop hole. but there are too many people with too much to lose should the sharif ship begin to sink.

its like watching an over of superb pakistani bowling in a world cup agains india. even though you know youre going to lose embarrassingly, at least the pleasure of watching that one over and the glimmer of hope it creates is a blessing.

His lawyer has all but admitted the money laundering and is making no real effort to defend it, instead is spending his time arguing for immunity. His ex lawyer even admitted there is no money trail.

How this guy has support and how he has not been impeached or been thrown out or has the shame to resign at the very least shows you where our country is at.

i agree. i cant find sources to follow it as closely as many of you here, but my gut tells me that he will weather the storm. failing that , shabaz gets in and its the same thing. i cant see a way out.

what i think should happen is that it is properly and fully established whether he stole from the country and whether he laundered money, in which case the properties are confiscated, he is dismissed as pm and stands trial, and then one by one, all the corrupt pocket feeders that perverted justice whilst on the sharif pay roll are uncovered, exposed and prosecuted one by one.

that will obviously never happen, particularly with the way that people vote and voice their opinions. its no surprise that the pmln supporters on pp, whether direct supporters or by disassociation with the pti, dont even have the self respect to admit their stupidity and myopia.

Shahbaz Sharif and Ch. Nisar are very quiet on Panama issue. I have rarely seen them coming on media and defending panama leaks. May be they don't want to get their hands dirty. @WebGuru :13

You're absolutely right. In any proper country this crook should have resigned quickly. But in our country EVEN TODAY people are saying ''what proof?''

Shehbaz and Nawaz have had tiffs mainly because the latter always gets the PM spot. During dharna and the model town killings, to stop PTI's protests N wanted S to resign. However it was widely reported that Hamza stopped his father and said how is it that their family always has to play second fiddle and give sacrifice? Shehbaz's wife has also openly spoke about Nawaz's corruption. When Nawaz was exiled Shehbaz apparently was forced to come along but Hamza stayed behind showing some guts.

Noon is in three camps, Nawaz, Shehbaz and Nisar. The latter is not trusted by both Sharifs, however neither Shehbaz has defended his brother anywhere and his family are keen to stay low in the hope if Nawaz is thrown out they might be in.

Shehbaz is quiet because there are 2 reasons one if NS goes down thn there is an opportunity for him and his son and second reason is even if he try to defend his brother openly thn PTI will also take him to cleaners. He recently tried to do it and within a couple of hours whole PTI was after him on media. Shehbaz Sharif was involved in Hudaiba paper mills case of London his hands are also not clean.

Power turn you blind. Benazir vs Murtaza Bhutto is another example from our history.

Maryam who changed her to Maryam Nawaz from her husband's name for political milage, now says her name was added as a dependent on the form because of no space on tax form.

Sickening how they think they can take us on a ride. Literally 2 days ago I listened to her 2011 interview where she says she's her father's dependent.
