    Sharjeel Khan attends preliminary hearing of the PCB Tribunal; Latif hearing on 31st March [Post #6]

    Lahore March 19: The three members of the Anti-Corruption Tribunal tasked with adjudicating the spot-fixing matter submitted their respective consents on Friday 17th March. The tribunal comprises of the following:

    Justice (Retired) Asghar Haider (Chairman)

    Lt. General (Retired) Tauqir Zia (Member)

    Former Test player and Team Manager Wasim Bari(Member)

    The members of the Tribunal were sent appointment notifications last week after the two accused players Khalid Latif and Sharjeel Khan formally informed PCB that they would contest the charges framed against them. If the players had admitted their guilt the matter would have been referred to the Chairman of PCBs Disciplinary Panel who would have simply determined the imposition of sanctions on the two players.

    As per the prescribed procedure the Tribunal will now issue notices for a preliminary hearing to both PCB and the players. At the preliminary hearing future procedure and dates of hearing will be decided.

    Moreover, at the preliminary hearing the Tribunal in consultation with PCB and the two players will decide when the PCB is to submit an opening brief detailing the claims against the two players along with the evidence to be presented and relied on; the date by which the players must respond/reply to the PCBs opening brief; and the date of the final full hearing.

    It is important to remind the media that the PCB Anti-Corruption Unit and Legal Department cannot share or provide any evidence before the scheduled date for presenting it before the Tribunal which is yet to be fixed by the Tribunal.

    Background:

    -Sharjeel Khan and Khalid Latif were provisionally suspended on February 10 under the PCB's Anti-Corruption Code as part of an investigation into alleged attempts to corrupt the 2017 Pakistan Super League (PSL). Both batsmen were sent home and summoned for a preliminary hearing soon after where they were further investigated by PCBs legal team and the ACU.

    -The players were handed over a charge sheet a week after they were sent home from the PSL in UAE. They were charged for breaching various articles under Clause 2, including specific ones to attempt to corrupt a game, as well as failure to disclose suspect approaches.

    -The specific articles of the PCB Anti-Corruption Code both violated are: 2.1.1, 2.1.2, 2.1.3, 2.4.4 and 2.4.5. In addition, Khalid Latif was charged for breaching code 2.1.4.

    - As per the PCBs legal procedure, the case was only referred to the tribunal since the two players decided to contest the charges laid against them by the ACU within the stipulated 14 day period after they were charged.

    -If the players had admitted their guilt the matter would have been referred to the Chairman of PCBs Disciplinary Panel who would have simply determined the imposition of sanctions on the two players.

    - The Tribunals proceedings shall commence with a preliminary hearing where the Tribunal in consultation with PCB and the two players will decide when the PCB is to submit an opening brief detailing the claims against the two players along with the evidence.

    -The Tribunal will also determine a date by which the players need to respond to the charges leveled against them and the evidence provided in PCBs opening brief after which the date of the full final hearing will be announced.

    -More than one day may be consumed in finalizing the matter(final hearing) after which the Tribunal will announce its findings.

    That is a truly appalling disciplinary committee. There's only 1 qualified lawyer, a soldier and a cricketer.

    Compare it with the panel that convicted Amir, Asif and Butt:

    Michael Beloff QC: eminent English barrister and judge, experienced in sports law.
    Justice Albie Sachs: senior South African judge
    Sharad Rao: senior Kenyan trial lawyer, experienced in cricket law, and chair of the Kenyan Judges' Vetting Panel, who at the time had 44 years of legal experience.

    But Sharjeel Khan gets tried by a soldier and a long-retired wicketkeeper.

    It's appalling.

    Tribunal to meet on March 24 for preliminary hearing

    Lahore March 20, 2017: The three members of the Anti-Corruption Tribunal tasked with adjudicating the spot-fixing matter have today issued notices to PCB, Sharjeel Khan and Khalid Latif to hold a preliminary hearing on Friday March 24 from 11:30am at the National Cricket Academy, Lahore. The tribunal comprises:

    Justice (Retired) Asghar Haider (Chairman)
    Lt. General (Retired) Tauqir Zia (Member)
    Former Test player and Team Manager Wasim Bari (Member)

    The Tribunal was constituted after the two delinquent players, Khalid Latif and Sharjeel Khan, formally informed PCB that they seek to contest charges levelled against them.

    As per the prescribed procedure the Tribunal will hold the preliminary hearing where as mandated by the Code timeline of future dates of hearing will be decided.

    Moreover, at the preliminary hearing the Tribunal in consultation with legal representatives of PCB and players will decide when the PCB is to submit an opening brief detailing the claims against the two players along with the evidence to be relied on; the date by which the players must respond/reply to the PCB’s opening brief; and the date of the final full hearing.

    It is important to reiterate that the PCB Anti-Corruption Unit or Legal Department cannot make public any evidence or material as under the Code the proceedings are confidential.

    Lahore March 24, 2017: The Anti-Corruption Tribunal held its preliminary hearing today at the National Cricket Academy, Lahore and the following were in attendance:
    1. Jus. Asghar Haider (Chairman)

    2. Lt. Gen. Tauqir Zia (Member)

    3. Mr. Wasim Bari (Member)

    4. Mr. Sharjeel Khan, along with Shaigan Ijaz Advocate

    5. Mr. Taffazul Rizvi, PCB’s Legal Advisor along with Haider Ali Khan Advocate

    6. Mr. Salman Naseer, GM Legal Affairs PCB

    7. Col. Mohammad Azam Khan, Head of PCB’s Vigilance and Security Department

    Counsel for PCB read out the charges leveled against Sharjeel Khan which included breaches of Articles 2.1.1; 2.1.2; 2.1.3; 2.4.4 and 2.4.5 of the PCB Anti-Corruption Code for Participants 2015.

    The Tribunal in consultation with both parties agreed upon the procedure and timelines to be adopted under the Anti-Corruption Code. PCB shall submit its opening brief detailing its claims along with the evidence to be relied on by 14th April 2017. This time period has been agreed in order to give the PCB ACU an opportunity to travel to UK to interview Nasir Jamshed and meet with relevant UK authorities and determine if any of its findings are to be incorporated in the prosecution.

    Sharjeel Khan shall be provided an opportunity to respond by 5th May 2017 and PCB may, at its discretion, file a rebuttal by 10th May 2017. The Final Hearing shall commence from 15th May 2017 on a day to day basis.

    Khalid Latif, Cricketer despite notice has not entered appearance. He made an application for adjournment via email to the Chairman of the Tribunal citing health reasons and requesting that proceedings be adjourned to next week. In the interest of justice the request is allowed and the proceedings in respect of Khalid are adjourned to 11:30am on 31st March 2017.

    Notice would also be issued with a stipulation that no further adjournment would be granted.

    Since under the PCB’s Anti-Corruption Code the proceedings are meant to be kept confidential, no comments will be made by any party or the Tribunal on the merits of the case.

    Why do you want the FIA to be given access. I do understand why Sethi is asking for PCB's own investigation first as they are the one who brought up the case, FIA can have CRIMINAL investigations later on once fixing is proven in front of tribunal.

    If Sethi had to keep it under the wraps then why would Sethi and PCB suspend them in first place? Don't know why you are blaming Sethi here.

    Should be given life ban. His career will be pretty much over anyways with 5years ban as well but should be life banned if guilty.

    I don't get it. The same 3 member committee handed them the charge sheet and now they will be the one hearing the case as well. Our media is ill informed in this case.

    This case is going to take a long time and if players not found guilty PCB should compensate them.

    After the trio fiasco, I thought we are done with fixing scandles and boys have learned a lesson or two but I was totally wrong. Even after all the anti corruption classes and seminars, greed got to them.
