    Najam Sethi’s election as PCB chairman challenged in LHC

    LAHORE: A petition challenging the election of Najam Sethi as Pakistan Cricket Board (PCB) chairman was filed in the Lahore High Court on Tuesday, ARY News reported.

    Advocate Nasir Iqbal petitioned the high court, contending that Najam Sethi was elected as the PCB chairman in flagrant violation of the PCB laws.

    He submitted that former prime minister Nawaz Sharif had nominated Sethi and Arif Ejaz to the PCB’s Board of Governors on July 09 for a three-year term with effect from August 06.

    Their nomination came before the term of former PCB chairman Shehryar Khan expired in violation of the relevant laws which stipulated that members of the board cannot be nominated before the expiry of the tenure of the incumbent PCB chairman.

    Moreover, the petitioner contended, the former prime minister who nominated them was later disqualified by the Supreme Court, thus the nomination of Sethi and Arif were rendered ineffective.

    He pleaded with the court to declare their nomination to the Board of Governors as unlawful and illegal.

    On August 09, the Pakistan Cricket Board had elected Najam Sethi as its 30th chairman in a Board of Governors meeting at the National Cricket Academy, Lahore.

    Earlier, he was elected to serve as PCB’s executive committee chief while Shahryar Khan was elected as the chairman in August 2014. Shehryar’s term expired on Aug 06.

    Earlier on July 09, the then prime minister Nawaz Sharif had approved the nomination of two members namely Najam Aziz Sethi and Arif Ejaz to the Board of Governors of the Pakistan Cricket Board (PCB) for a three-year term starting from 6th August, 2017.

    LHC dismisses petition against Najam Sethi

    LAHORE: The Lahore High Court on Friday dismissed a petition challenging the nomination of Najam Sethi as member Board of Governors (BoG) of Pakistan Cricket Board (PCB) and his subsequent election as chairman of the board.

    Representing the petitioner, Advocate Naheed Baig argued before the court that the election of Mr Sethi had been conducted in violation of the board’s Constitution and rules. She said former prime minister Nawaz Sharif, being patron of the PCB, violated rules by nominating Mr Sethi and Arif Ijaz to the BoG much earlier to the dissolution of the previous board.

    The counsel further argued that the respondent (Sethi) was elected as new chairman before the expiry of the term of his predecessor, Shaharyar Khan. She asked the court to declare the election of Sethi null and void and immediately restrain him from performing his duties as chairman.

    In his counter arguments, PCB legal advisor Taffazul Haider Rizvi objected to the maintainability of the petition calling it a frivolous one. He pointed out that a similar petition had been recently dismissed by Islamabad High Court and argued that the patron, under the Constitution, had the power to nominate any person to the BoG.

    Moreover, he said the election of the chairman was not conducted by Sethi but the election commissioner retired Justice Afzal Haider, duly appointed by the patron.

    Advocate Rizvi pointed out that an independent adjudicator comprising another retired justice was also formed to hear, as first legal remedy, objections aga*inst the election. However, he said, the adjudicator received no objection against the election of Mr Sethi.

    After hearing both sides, Justice Mamoon Rashid Sheikh dismissed the petition for being not maintainable.

    He's doing well under very challenging circumstances.

    The next big ticket item on his agenda will be selling Pakistan cricket's broadcast rights from 2020 onwards. The valuation of which heavily depends on what agreement can be made with BCCI. The previous 5 year cycle rights (sold in 2015) was for USD 150 million, of which half was dependent on an India series being hosted. If he is successful in coming to an agreement with the BCCI, PCB sets to gain the full payment plus it bodes well for the pricing in the upcoming bids.

    If anyone can pull of a miracle, it is Mr. Sethi.

    Legally, I don't think anyone can do much. This guy Sethi is well educated and aware of rules/regulation, and he is quite stubborn as well. Even if there is a change in Govt. (political Govt.), NS might step down on his own, but he won't be sacked - I am sure, he has that part covered in PCB's constituency.
