    Contempt petitions against Imran Khan dropped after ECP accepts apology [Update Post #14]

    The Election Commission of Pakistan (ECP) on Thursday issued non-bailable arrest warrants for Pakistan Tehreek-i-Insaf (PTI) Chairman Imran Khan in the contempt of court case against him for "repeatedly failing to appear for the hearing and for failing to send a written apology to the ECP for his absence in court".

    The ECP has ordered that the PTI chairman be arrested and brought to the next hearing of the case filed by PTI dissident and one of the party's founding members, Akbar S. Babar, on October 26.

    According to PTI Spokesperson Naeemul Haq, the party is set to challenge the warrants in the Islamabad High Court (IHC).

    In today's hearing — headed by Chief Election Commissioner (CEC) retired Justice Sardar Muhammad Raza — the ECP suspended proceedings as soon as they began and the members reconvened in the chambers.

    During the meeting, the ECP decided to issue non-bailable warrants for Khan.

    Earlier on September 14, the ECP had issued bailable arrest warrants for Imran Khan following his failure to show up for the contempt of court proceeding, which were later suspended by the IHC on the PTI's petition.

    "A new warrant is issued in the same case where a [bailable] warrant was already suspended. We will also look into whether this is contempt of the IHC's full bench or not, and then [the party] we will challenge it," said PTI member and lawyer Babar Awan.

    In August, the ECP had issued a second show-cause notice to Imran Khan after he failed to reply to the earlier notice regarding the contempt of court proceedings against him.

    Imran Khan had initially challenged maintainability of the contempt petition and raised objections over ECP’s jurisdiction to initiate contempt proceedings against him; the commission, however, declared on August 10 that it had the legal right to hear the contempt case.

    It had then issued a formal show-cause notice to the PTI chairman, asking him to submit a reply by Aug 23.

    PTI chief's counsel Babar Awan had then appeared before the five-member ECP bench and pleaded that they wanted to challenge the ECP’s judgement regarding the maintainability of the contempt petition and hence, should be granted some time to do so.

    Imran Khan had accused the ECP of being biased in the foreign funding case following which his counsel had tendered an apology with the commission. However, the PTI chairman in a TV interview later said that his counsel had tendered an apology in his personal capacity and that he had not apologised.

    So guys that are there to run elections can now have people arrested for contempt for criticism , whilst the royal family are in contempt of the real court every day and nothing is done.

    Surely even you would agree issuing the arrest warrant was above their authority? So the correct decision is being made?

    when does the ECP have the authority to issue arrest warrants? lol..and its a biased , politically influenced body that cannot be trusted. this is just to distract and keep imran distracted. Pathetic from the roana dhona nooras.

    I do not know about the authority of ECP.
    IMO, ecp or any other court should make a decision based on evidence presented to them. No need for the accused party to be present.

    This is 4 years old case. Filled by a founding member of pti.
    It is now evident that IK misused party funds and ecp would decide against IK then case will be transferred to regular courts.

    ECP sends Imran Khan's arrest warrants to Islamabad SSP Operations

    ISLAMABAD (Dunya News) – The Election Commission of Pakistan (ECP) has on Tuesday sent Pakistan Tehreek-e-Insaf (PTI) Chairman Imran Khan’s arrest warrants to Islamabad SSP Operations.

    ECP Director General (Law) has asked the relevant authority to arrest Imran Khan and present him before the commission on October 26 at 10:00 AM.

    ECP had on October 12 issued non-bailable warrants against Imran Khan in contempt of court case over failure to appear before it. The addresses of Imran’s Bani Gala residence and PTI party office in Blue Area have been mentioned on the warrants.

    PTI leader Babar Awan had declared the ECP decision unconstitutional and said the party will file a petition in Islamabad High Court (IHC) against the verdict. He said the decision was hastily announced without determining the jurisdictions.

    The Election Commission of Pakistan (ECP) on Thursday ended contempt proceedings against Pakistan Tehreek-i-Insaf (PTI) Chairman Imran Khan after accepting his written apology.

    The PTI chief finally appeared before the commission today, nearly two weeks after his non-bailable arrest warrants were issued, in connection with the contempt of court case.

    PTI counsel Babar Awan, Secretary General Jahangir Tareen and leaders Shafqat Mehmood and Naeemul Haque are accompanying Khan at the ECP, DawnNews reported.

    During the hearing, Chief Election Commissioner retired Justice Sardar Muhammad Raza directed Khan's lawyer to submit a written apology over his remarks accusing the ECP of bias in the foreign funding case.

    Awan argued that the PTI chief had apologised twice over his remarks, but the election commissioner directed him to submit a written apology signed by Khan.

    Khan and his lawyer then penned down the apology before submitting it to the ECP, DawnNews reported.

    After months of foot-dragging over the issue, the PTI had announced that its chief would "voluntarily" appear before the ECP last week. The announcement had come on the heels of ECP's decision to issue non-bailable arrest warrants for Khan on contempt charges.

    The warrants, which were suspended by the Islamabad High Court (IHC) earlier this week, were issued on October 12 following Khan’s continuous failure to appear before the ECP on the show-cause notice issued for “defaming and scandalising” the ECP in the foreign funding case.

    While the PTI announced that Khan would appear before the commission voluntarily and without prejudice to the party’s view about the jurisdiction of the ECP on contempt, the ECP said it enjoyed clearly defined powers under the law to try and punish contemnors.

    ISLAMABAD: Pakistan Tehreek-e-Insaf chairman Imran Khan on Thursday defied the Election Commission of Pakistan (ECP) by addressing a rally in Lodhran.

    The move is likely to force the commission to take action against Imran Khan and PTI’s candidate Ali Khan Tareen, as both have been asked through separate letters to abide by the code of conduct for the by-election in Lodhran-I.

    “We are looking into the matter and will take due action as per law. We have taken notice,” ECP spokesman told The Express Tribune.
    He stated that the notice has been served on the persons concerned in this connection.

    Imran reminded to adhere to ECP code of conduct as Lodhran by-elections loom

    In the letters, the ECP had invited the attention of Khan and Tareen to abide by the code of conduct under which no parliamentarian can visit the constituency or a polling station after issuance of the schedule of by-election till the completion of the election.

    The letter stated that as per information, the PTI has planned a public rally at Fiber Cotton Factory, Adda Pipli Wala, Multan Road Lodhran, which may be attended by parliamentarians and general public.

    According to the letters, as per the code of conduct and directives issued by the ECP on December 20, 2017, parliamentarians — including the prime minister, chief minister, federal ministers, state ministers and advisers of CMs or any person on their behalf shall not visit the constituency or a polling station after the issuance of schedule of by-election till the completion of poll.

    It stated that the ECP expects political parties, their leadership and candidates to comply with the code of conduct to increase public support for fair and transparent elections.

    “As the above area is part of the constituency NA-154 (Lodhran-1) where by-election is scheduled to be held on February 12, 2018; therefore, your advised to abide by the Code of Conduct in letter and spirit,” stated Regional Election Commissioner/District Returning Officer, NA154 Lodhran-1, Syed Hammad Ijaz.

    The seat fell vacant after the apex court disqualified Jahangir Tareen for not disclosing his assets.

    ECP says returning officer to decide on MQM-P Senate nominations

    Following his disqualification his son Ali Khan Tareen had submitted his nomination papers to contest the by-election.

    The constituency is witnessing by-poll for the second time in the last five years.

    In the general election of 2013, Muhammad Siddique Khan Baloch won as an independent candidate. In 2015 by-election held after the disqualification of MNA Siddique Baloch.

    In 2015, Jahangir Khan Tareen of the PTI elected MNA but he was also disqualified on December 15, 2017, by the Supreme Court of Pakistan
