    A special bench presided by Chief Justice of Pakistan Mian Saqib Nisar is hearing of a suo motu notice pertaining to the eight-year-old rape and murder case in Kasur at the Supreme Court Registry in Lahore, Express News reported.

    During the hearing on Sunday, Joint-Investigation-Team (JIT) led by RPO Multan Muhammad Idrees presented a report detailing inquiry into the rape and murder of Zainab and at least eight other under-age girls. The JIT found it to be eighth such incident within jurisdiction of three police stations involving the same suspect as per DNA match in Kasur since 2015.

    JIT head gave a multi-media briefing to the bench, explaining the events of Zainab’s disappearance and rape, murder. He said Zainab was kidnapped on January 4 while she on the way to her aunt’s place for religious lessons. Once the family realised she was missing, they informed police through the helpline 15.
    Muhammad Idrees informed the court that the police had taken DNA samples of over 800 possible suspects, adding that DNA result of Zainab’s rapist, murderer had matched with those from seven previous cases of the same nature.

    Man wanted for Zainab’s murder allegedly involved in 8 more rape cases

    Unsatisfied by the investigation report, CJP inquired about the Station House Officer (SHO) posted in the district for last three years, asking why was he not removed despite complaints by residents. He observed that such incidents had been taking place in two jurisdictions since 2015 yet the police had not taken made any inquiry.

    The SC judges noted that the police was only relying on DNA tests when they could use other resources to apprehend the suspect. They remarked that the method taken by investigating team would require taking DNA samples of 21 million people, directing police to take measures other than DNA tests to solve the case.

    The bench reprimanded Kasur police for failing to take notice of crime when it was first reported in 2015. “If the police had taken first case that surfaced in 2015 seriously, eight young girls would not have been raped and murdered.”

    JIT members including Chief Secretary Punjab Zahid Saeed, Director-General Punjab Forensic Science Agency Dr Muhammad Ashraf Tahir appeared before the court. Parents of Zainab and other eight victims are also present in the courtroom.

    The former JIT head Additional Inspector-General Abu Bakr Khudabakhsh also appeared before the court. He was removed from the team upon the objection of Zainab’s father. AIG Khudabaksh had previously led the JIT formulated pertaining to the Kasur Video Scandal in 2015.

    Inspector-General of Police Arif Nawaz is also expected to submit a report on suspects arrested by the police in the case.

    The body of the minor child was found in a garbage dump days after she went missing from her home. Taking notice of the horrific incident, the CJP had taken suo-moto notice of the incident on January 10.

    The parents of eight girls who had been raped and murdered in Kasur since 2015 appeared before the Supreme Court on Sunday and pleaded for justice.

    "Give us justice," the parents ─ including those of six-year-old Zainab whose body was found in a trash heap on January 9 ─ pleaded before a three-member bench of the apex court.

    The bench, headed by Chief Justice of Pakistan Mian Saqib Nisar, was hearing a suo motu case on the grisly rape and murder of the six-year-old that shocked the nation this month.

    Zainab's uncle was present in the courtroom for the hearing, which was conducted at the SC's Lahore registry.

    During the hearing, the bench expressed its dissatisfaction over the progress of the investigation into Zainab's murder.

    "An unspeakable crime has been committed against an innocent girl," the bench remarked.

    Muhammad Idrees, the regional police officer of Multan and head of the joint investigation team probing the case, submitted to the court a report on the investigations.

    He said that Zainab's case is the latest in eight similar incidents of assault and murder since 2015.

    The bench remarked that if the police had taken the matter seriously in 2015, eight girls could have been saved.

    When the RPO told the court that DNA tests of 800 suspects have been conducted, the bench remarked that the police is pursuing a one-track investigation and must widen the scope of the probe beyond simply using DNA testing to track down the culprits.

    "The DNA tests of 21 million people will have to be conducted if the investigations continue in this way," the bench said.

    The chief justice told Zainab's family that they should inform the court of any complaints they may have.

    "The JIT is doing satisfactory work," the family members responded.

    "We pray that the team is successful [in it's probe]," they added.

    The bench summoned the JIT and other parties in the case to appear in the court chambers for the next hearing.

    RPO recounts events of Zainab's 'disappearance'
    During the hearing, RPO Idrees recounted the events of January 4, the day that Zainab went missing in Kasur.

    He said that at 7pm that day, Zainab left her house to go to her aunt's house ─ located at a distance of 300 kilometres ─ for Quran lessons.

    According to the RPO, Zainab's brother, Usman, would normally accompany her to their aunt's house but did not do so on January 4.

    He added that when Zainab did not return home, her family began searching for her and informed the police at 9:30pm.

    Zainab's body was recovered from a trash heap on Jan 9. The six-year-old's autopsy confirmed that she was strangled to death. It suggested that she had been raped before being killed.

    He said that the culprit behind the seven cases of assault and murder of minor girls that preceded Zainab's is also responsible for this latest case.

    He added that all incidents have taken place within the jurisdiction of three police stations, with the first two incidents having taken place in the remit of the Saddar Division police station.

    "So many incidents have taken place, what was the police doing?" the court questioned.

    "The incidents took place repeatedly in the remit of two police stations and no one conducted an inquiry," the chief justice observed.

    No major headway has been made in the case since Zainab's body was found, despite the Counter-Terrorism Department, Intelligence Bureau, Special Branch and Punjab Forensic Science Agency each being tasked with investigating the case.

    Kainat's medical treatment
    During today's hearing, the court inquired after the medical treatment being administered to six-year-old Kainat Batool, who went missing in Kasur in November 2017.

    After an exhaustive search, Kainat was found alive in a trash heap and admitted to Lahore's Children's Hospital for treatment where doctors said that no evidence of sexual assault had been found on her body. However, Kainat's family denied this account, saying there were torture marks on the child's body.

    A medical superintendent from the hospital, appearing before the bench today, recalled that Kainat had been admitted on Nov 13 last year and underwent treatment there for a month.

    The chief justice asked the medical superintendent to inform the court about the possible treatments that could be provided to the child. He added that if required, Kainat should be sent abroad for treatment.

    The medical superintendent told the court that a board meeting is scheduled to be held at the hospital tomorrow and a plan for Kainat's treatment will be formulated then.

    Zainab case: JIT ‘back to square one’ as DNA report clears suspect

    LAHORE: The Joint Investigation Team is once again groping in the dark to find the culprit in Zainab case after the DNA report cleared the suspect arrested recently by Lahore police.

    The report issued by the Punjab Forensic Science Agency (PFSA) cleared 23-year-old suspect Umar Farooq on Monday.

    The JIT formed by the Punjab government to investigate the case had dispatched the samples of the suspect to the PFSA for DNA analysis a week ago.

    According to sources, the Punjab police high-ups were hoping breakthrough in the case as the suspect during interrogation had “confessed to his crime”.

    A senior police official privy to the investigation process told Dawn the suspect was taken into custody by a police team in a ‘massive raid’ conducted in Cantonment area of Lahore a week back.

    The “arrest” came after the city police authorities were tipped off by an informer that a suspect having close resemblance to the sketch of the man shown in Zainab’s CCTV footage was seen near Bhatta Chowk.

    After recce, he said, a police contingent conducted raid at Bhatta Chowk and picked the suspect. He was taken to an undisclosed place where he was interrogated by some senior police officers.

    He said the South Cantt station house officer had also prepared his confessional statement before presenting him to the high-ups.

    Interestingly, the SHO in his report also gave reference of a call made by Umar’s aunt on his (Umar) mobile phone.

    During the conversation, she had also discussed Zainab’s abduction and rape, quoting the SHO’s report, the police official said.

    During interrogation, the Lahore police officers concerned came to know that the suspect was previously a resident of the same area where Zainab’s parents lived and was presently living in Bhatta Chowk area.

    The revelation further strengthened their suspicion that the suspect might have been involved in the crime.

    Expecting “a breakthrough”, they handed over the suspect in strict custody to Kasur police for further interrogation as the JIT was investigating the case there.

    Following the clearance of the suspect in the DNA report, the police official said, the JIT members decided to explore more leads to trace the wanted man.

    Zainab murder case: arrested suspect's DNA matches samples taken from crime scene

    A suspect whose DNA matches with samples taken from the body of six-year-old Zainab Amin, who was raped and murdered in Kasur earlier this month, has been arrested, DawnNews reported on Tuesday citing police sources.

    On January 4, Zainab went missing after leaving her house on Kasur's Road Kot area for her maternal aunt's house a few minutes away for religious lessons.

    A few days later, the victim's body was recovered from a trash heap. An autopsy confirmed that she was strangled to death. It suggested that she had been raped before being killed.

    The suspect arrested today is a resident of the same area where Zainab's house is located, and lives very close to the victim's aunt's house, the sources said.

    His appearance matches that of an individual seen with Zainab in CCTV footage recovered by police, according to the sources.

    He was arrested as part of the investigation earlier but was let go, the sources said, adding that he was arrested again after more evidence was collected.


    'Suspect disguised himself'

    Malik Ahmed Khan, a spokesperson for the Punjab government, told DawnNews that the suspect was arrested from Pakpattan.

    "We have found some initial evidence [against the suspect] and there is well-found reason to believe that he is the culprit," the spokesperson said.

    Khan, citing police, said that the suspect used to disguise himself. "Sometimes he would keep a beard, sometimes he would wear spectacles, and he would change his clothes," Khan said, adding that some of the suspect's accomplices are also in police custody.

    The provincial government spokesperson added that a detailed forensic report would be available at 7pm, after which he would be able to confirm the reports. He said all details would be shared with the media then.

    He said that suspects who had been arrested earlier were released when the DNA reports cleared them.

    Earlier, Punjab Law Minister Rana Sanaullah, while speaking to DawnNews, neither confirmed nor denied the reports, saying that the Punjab government would brief the media on the matter itself.

    Zainab's rape and murder had sparked outrage in Kasur and across the country. The day her body was found, protesters had taken to the streets in Kasur, agitating against perceived police inaction.

    The police had gone into overdrive, scrambling for leads to solve the heinous crime. Earlier, the investigation team formed to probe the crime had arrested a 23-year-old suspect. However, he was released after a DNA report cleared him.

    Although the latest news confirms the matching of DNA report of a suspect, the role of media and police has been very unprofessional.
    Police have conducted way too many DNA samples, while exposing identities of plenty of them to media as well. This could have caused troubles for those innocent suspects and their families.

    Anyway, I hope the right man has been caught and it isn't just some poor man who has been forced into a confession. Beyond that, there needs to be a severe crackdown in these districts where numerous such attacks have taken place. Is it just an individual or a group/gang? How have they evaded capture so long ?

    I wouldn't put it past SS. He is under massive pressure due to NAB's disclosures, so this way is a quick way to demonstrate some goodwill.

    Exactly, this shows that police can do a way better job if allowed and empowered to do so. It took more than mere protests, these were riots which prompted every one into action. People's trust on government and institutions was at its lowest ebb which prompted judiciary, media, administration into action.

    If any one, those two protesters who died at the hands of a cowardly policeman deserve the credit of his capture.

    It is a good news that the culprit is caught but if Showbaz is eager to take credit for his arrest , he should also take the blame for indifference that his handpicked police officers showed in the past.

    Zainab's murderer should be hanged publicly: Shehbaz Sharif

    Punjab Chief Minister Shehbaz Sharif said that the rapist and murderer of innocent Zainab had been caught with the collective efforts of civil and military agencies.

    Earlier on Tuesday, a senior police official confirmed to The Express Tribune that the suspect in the rape and murder case of eight-year-old Zainab in Kasur had been apprehended.

    “I’m confirming that the Zainab’s rapist and murderer has been nabbed after consecutive efforts for the last 14 days to this effect,” Shehbaz said while addressing a news conference in Lahore on Tuesday evening.

    He was flanked by Zainab’s father besides other provincial officials.

    “The culprit, Imran is 24-years-old, is a resident of Kasur and a serial killer,” the chief minister added.

    Shehbaz went on to say that the arrest only became possible with the collective efforts of the civil and military intelligence agencies.

    “I’m grateful to MI [Military Intelligence] and the ISI [Inter-Services Intelligence] for their cooperation to nab the culprit,” he said, adding, “I’m especially thankful to the forensic department which ran 1,150 DNA samples in order to materialise the arrest.”

    The Punjab CM further said: “I request the chief justice to ensure swift justice and exemplary punishment to the innocent girl’s murderer.”

    Zainab was kidnapped on January 4 from near her aunt’s house in Kasur. Her body was discovered five days later from a garbage heap. The post-mortem report revealed that she had been raped and murdered.

    The man arrested for the murder was not only close to her family but was also helping them when they were searching for her when she went missing earlier this month. Imran was a frequent visitor to the minor’s house.

    A mechanic by profession, the prime suspect also participated in the protests held against the girl’s murder.

    Imran was picked up earlier by the police, but was released after Zainab’s family intervened, identifying him as someone familiar and trusted.

    Great relief that the animal was arrested (and i hope he is the real culprit).

    Great job by social media, locals and mainstream media for literally FORCING police & authorities to take an action otherwise this would've continued forever.

    I hope the pressure continues on authorities to take strict action against wider child abuse case in Kasur which impacted hundreds of kids. This should also force whole country to take extreme measures to educated public and strict laws to prevent child abuse.

    How disgusting? They first clap and celebrate in front of media in presence of victim's father. This DPO was actually demanding Rs 10,000 from victim's family for finding her dead body when there was no media pressure or protests.

    Then victim's father was briefed what to say in press conference and Shahbaz Sharif actually turned his mic off when father started speaking.

    Chief Justice of Lahore High Court (LHC) Mansoor Ali Shah has ordered a daily hearing of eight-year-old Zainab’s rape and murder case, the first hearing will be held later today.

    The case will be heard in an Anti-Terrorism Court (ATC), prime accused Imran, who was arrested and apprehended by the police yesterday, will appear before the court.

    Kasur rape case: Murderer of 8-year-old Zainab arrested
    Addressing the media in Bhawalpur, Justice Shah said that Punjab Chief Minister Shehbaz Sharif briefed the media and requested for a quick verdict in the case. “I am also addressing the media to let the chief minister know that there will be daily hearings on the case,” he said.

    Justice Shah also said that he has directed district judges to ensure daily hearings and to reach a verdict as soon as possible.

    The accused, Imran, faces charges of murdering eight girls in Kasur, and will appear in front of the ATC amidst tight security measures. ATC Judge Sheikh Sajjad will conduct the hearing today.

    Initial reports reveal that police will submit a report related to the accused in the court. The hearing will then begin with charges of rape and murder of children.

    What led to the culprit’s arrest

    A police official from the investigation team formed to find Zainab’s murderer told BBC of the entire process through which the prime suspect was apprehended.

    “It was like finding a needle in a haystack,” the official said. The process involved investigating the entire population of Kasur which is 30,000,000. The investigation team states that they narrowed down the population to 60,000-70,000 people excluding women and the elderly.

    Out of them, around 1,100 were checked for DNA, and it was the 814th DNA sample that matched with the one of the killer.

    Another interesting point the investigation team discussed was the jacket the man in the CCTV footage was wearing. The team analysed that the man was wearing a jacket with a button on the front side of each shoulder.

    However, the footage did not show the original colour of the coat, which meant it could be any dark coloured coat. The police recovered a black coloured jacket with the same buttons in Imran’s house. The team stated that Imran’s mother also helped them apprehend the suspect.

    The team also stated that Imran did not struggle much and testified easily. They also said that had the local police done their work efficiently, they would have caught Imran well in advance. “Imran is not only a serial killer, but a serial pedophile as well.”

    Imran’s mother and paternal uncle had doubts about him when they saw the CCTV footage of Zainab’s killer on TV, but never approached police.

    I just hope the right man has been caught and it's not some poor man who has no way to defend himself. Sadly, I have no trust in the Pakistani authorities. Hopefully they haven't just thrown an innocent under the bus to take the heat off themselves in order to save someone who is well connected/influential.

    DNA tests suggest Iman was killed by the same man suspected of murdering another child this month. The rape and murder of six-year-old Zainab Ansari earlier this month sparked outrage and protests across Pakistan.

    Police working on the investigation into Zainab's murder have discovered DNA traces matching those found in seven other attacks on young girls in the same city. Out of the seven attack victims, four - including Iman - were murdered.

    Until now, police and Iman's family thought her case had already been solved - but her family now believe the real killer is still on the run, while Mudasir was innocent.

    Takes time, from what I gather army understand that Pakistan can’t continue to function old ways, need stability, and old corrupt politician can’t provide it. Army also understand and have realized that only civilian government can provide that, army isn’t in mood of toppling government anymore, it won’t do any good to neither Army’s image nor it will help internationally given the current situation surrounding Pakistan. Army of Pakistan will remain the biggest and the most powerful entity in Pakistan no matter what.

    How can politicians and others make so many bold statements about this man before he’s even had a trial?

    I know there is no jury system in Pakistan therefore the chances of prejudicing the trial may be a bit lower than in some other countries however such statements must make life very difficult for the judge(s) hearing this case.

    This guy may well be guilty of this henious crime however one of these days an innocent man or woman could be accused of something similar and there could be a miscarriage of justice just because politicians and media folks want to pat themselves on the back and show the world how great they are.

    LAHORE: As DNA test report is not admissible as an evidence as per a ruling of the Supreme Court of Pakistan and the Qanoon-i-Shahadat, therefore the investigation team will have to produce some other evidence that could corroborate the Punjab Forensic Science Agency’s report of the alleged rapist and killer of minor girls in Kasur to ensure his conviction.

    It transpired during background discussions with officials of the Punjab government who guide it on legal matters, both civil and criminal.

    A senior official said the Lahore High Court had in certain cases allowed DNA reports as evidence, but he too admitted that the restriction imposed by the Supreme Court in this regard could be a hurdle in the suspect’s conviction.

    DNA test is considered an admissible evidence in most of the countries because of, what the legal experts said, its basic function of irrefutably identifying the involvement of a person in a crime.

    Chief Minister Shahbaz Sharif had on Tuesday night said the DNA tests had established that Imran Ali was the “culprit” in the Kasur rape and murder cases, including that of Zainab, that shook the entire country. He had also mentioned the success of polygraph test of the suspect that is conducted to establish if a suspect was lying or not.

    Some media reports indicated that the investigation team had obtained vital evidence of the suspect who was remanded into their custody for interrogation by an anti-terrorism court on Wednesday.

    According to insiders, a Supreme Court bench comprising Justice Asif Saeed Khosa, Justice Mushir Alam and Justice Dost Muhammad had in criminal appeals (No 497 and 496) of 2009 declared on October 15, 2015 that under Section 510 of the Criminal Procedure Code (CrPC) the report of biochemical expert (a biochemist) on DNA was not covered thus it was open to a serious debate because under the above mentioned provision of law, specified experts’ reports, excluding the report of the (DNA) expert, have been made admissible.

    “This aspect would be discussed and decided in some other cases elaborately. However, at present we are unable to hold the same as an admissible piece of evidence in absence of any sanction of law,” the judgment says.

    Elaborating how DNA tests could be faulty and which measures had been taken by various countries to prevent this, the court declared: “In any case, it is an expert opinion and even it is admitted into the evidence and relied upon, (it) would in no manner be sufficient to connect the necks of the appellants with the commission of the crime when the bulk of other evidence has been held by us unbelievable thus no reliance can be placed on it to award a capital sentence.”

    In another paragraph, the court maintained: “As discussed earlier, the entire case of the prosecution is based on circumstantial evidence. The principle of law, consistently laid down by this court is that different pieces of such evidence have to make one chain, an unbroken one where one end of it touches the dead and the other the neck of the accused.”

    Insiders said the Punjab government had established its forensic science laboratory under an authority with millions of rupees and employed the top most technical people to run it so as to have the criminals punished with solid undeniable scientific evidence like the DNA reports like many other countries which had adopted the technique around three decades ago.

    In view of the judgment, an effort was made to insert a new clause in the Qanoon-i-Shahadat to make the DNA reports admissible evidence. But, the effort could not succeed due to certain reasons.

    “We need to consider the issue very seriously at the national level. Declaring DNA reports admissible evidence is necessary to punish criminals in our country where weak police investigations lead to acquittals and eye-witnesses are either shooed away or are eliminated,” an official said.

    Some other law-knowing officials said till this was done, the government agencies concerned should find other evidence that could corroborate the DNA report of the suspect in Kasur case.

    “If he is the actual killer he should not be allowed to take benefit of any legal flaw,” an official said, also advising the police to have his confessional statement recorded in the presence of a judicial magistrate to give it authenticity. “A confession before police is of no legal value,” he remarked.

    So this guy could walk free because DNA evidence might not be allowed in his trial? This is a direct consequence of this:

    That the supreme court would side with the clergy on this issue two years later is even more disgraceful than the clergy making this ruling in the first place because at least the clergy's doing what it's supposed to be doing, making our lives more difficult and miserable, but the Supreme Court was supposed to be the stalwart against this kind of nonsense. As things stand, under Pakistani law, the most reliable way to ensure "justice" is to find four pious male Muslim eyewitnesses or the DNA evidence may not be used. This under a law that contains gems like this (taken from the original text of the law):

    'when a man is prosecuted for rape or an attempt to ravish, it may be shown that the
    prosecutrix was of generally immoral character.'
    This same law has previously resulted in victims going to jail while rapists walk free. In this case, this is what the director general of the Punjab Forensic Science Agency had to say about the accused's guilt:

    “It is nobody else on this planet but him [Imran Ali]. The DNA shows a match and that is the gold standard”
    While DNA evidence has occasionally been allowed on a case by case basis, it is not a foregone conclusion that it will be in this case considering the legal barriers against it. If this case falls apart because of CII and the Supreme Court's shenanigans, I'd be very interested in seeing the protests against Qanoon-e-Shahadat and the CII/SC who thwarted amendments to it allowing DNA evidence.

    That the supreme court would side with the clergy on this issue two years later is even more disgraceful than the clergy making this ruling in the first place because at least the clergy's doing what it's supposed to be doing, making our lives more difficult and miserable, but the Supreme Court was supposed to be the stalwart against this kind of nonsense.     While DNA evidence has occasionally been allowed on a case by case basis, it is not a foregone conclusion that it will be in this case considering the legal barriers against it. If this case falls apart because of CII and the Supreme Court's shenanigans, I'd be very interested in seeing the protests against Qanoon-e-Shahadat and the CII/SC who thwarted amendments to it allowing DNA evidence.
    DNA's admissibility as primary evidence is a developing concept of law. SC does not deserve your wild criticism when it has never considered DNA as non admissible. CII and lawmakers are equally responsible for this loophole in the law of evidence. As usual we lag behind the world in this case too.

    According to you, it is a stigma on PTI because the killer is a barelvi and thus probably has some attraction towards TUQ too. So, because PTI staged a dharna together 4 years ago and supported TUQ's demand for justice to 14 murders in model town, PTi is also to share the blame?

    I won't say that police have done any marvelous job in that case but regarding CCTV, can't you simply think yourself that CCTV cameras in a village is not a commonality in Pakistan?
