    Supreme Court questions how absconder Ishaq Dar won Senate elections

    The Supreme Court on Wednesday extended the deadline for the accountability court hearing three references against the Sharif family and the assets case against former finance minister Ishaq Dar.

    The apex court wondered how Ishaq Dar was elected in the Senate when he has been declared an absconder by the judiciary.

    Justice Ejaz Afzal Khan observed that when someone is declared an absconder he losses all his rights. Therefore, the right to contest to elections is also stripped away.

    “The accountability court judge gave reasons why the trial was not finalised but he did not seek specific time to conclude the trial,” said Justice Ejaz Afzal Khan.

    The top court has granted three months extension in the Ishaq Dar case, and two months extension for the Al-Azizia Steel Mill, Flagship Investment and Avenfield Apartments references.

    Former premier Nawaz Sharif, his daughter Maryam Nawaz, son-in-law Capt (retd) Safdar, and sons Hassan and Hussain Nawaz are all accused in the references filed by National Accountability Bureau.

    A three-judge bench headed by Justice Ejaz Afzal Khan granted the extension.

    All references filed by the anti-graft watchdog against the former prime minister and finance minister were to be concluded in three months.

    An accountability court last year declared the former finance minister a proclaimed offender after he failed to appear before it despite repeated summons. A warrant was also issued for his arrest after he missed several court appearances on charges that he had amassed wealth beyond his known sources of income.

    Dar has denied all charges, as has former prime minister Nawaz Sharif, who also faces corruption cases after being ousted by the Supreme Court in July.

    SLAMABAD: The interior ministry informed the Supreme Court on Saturday that red warrants had been issued to bring former foreign minister Ishaq Dar back to the country.

    A three-member bench headed by Chief Justice Mian Saqib Nisar had taken up the matter of Mr Dar’s repeated absence from hearings despite being given several directions.

    The attorney general also told the court that the cancellation of Mr Dar’s passport would be used as an alternative option if he continued to refuse to return to Pakistan.
    He said the interior ministry on a request of the Federal Investi*gation Agency had issued red warrants and was now waiting for a reply from Interpol. The court was also informed that Mr Dar’s properties in Pakistan had been forfeited.

    Mr Dar’s presence had been sought by the Supreme Court in a suo motu case regarding the appointment of playwright and columnist Ataul Haq Qasmi as chairman of the state-run Pakistan Television (PTV) on a hefty package. Mr Qasmi was looking after the affairs of PTV after the three-year contract of former managing director Mohammad Malick expired on Feb 26, 2016. Mr Dar was asked to come to the court and explain why Mr Qasmi had been appointed to the prized post at such a hefty salary.

    Ishaq Dar assets reference: Second prosecution witness records statement

    ISLAMABAD: An accountability court on Wednesday heard a corruption reference pertaining to owning assets beyond means against former finance minister Ishaq Dar.

    As Judge Muhammad Bashir of Accountability Court - I resumed hearing the case, the prosecution presented its second witness, Ishtiaq Ahmed, to record their statement.

    On July 21, the Federal Investigation Agency issued a 'red notice' for former minister to the International Criminal Police Organization (Interpol), sources had informed Geo News.

    Sources said the Interpol has been requested to assist in bringing back Dar to Pakistan to face the corruption case against him.

    Dar, a former senator, has been in London since October last year on account of his medical treatment and has been declared an absconder in the corruption case against him.

    Sources said the National Accountability Bureau (NAB) had requested the Interior Ministry for the issuance of the red notice. Late last year, an executive board meeting, chaired by Chairman NAB Javed Iqbal, had decided to bring Dar back to Pakistan with the help of the Interpol.

    "He [Dar] is suffering from no such ailment that cannot be treated in Pakistan," a notification issued by the anti-graft body had said.

    The case

    The former finance minister is accused of possessing assets disproportionate to his declared sources of income.

    A reference against the former finance minister was filed by NAB in light of the Supreme Court's July 28 verdict in the Panama Papers case.

    Dar had earlier been declared a proclaimed offender by the accountability court due to his continuous absence from the proceedings.

    In November 2017, then-prime minister Shahid Khaqan Abbasi had accepted Dar’s request to be relieved of his duties as the finance minister.

    ISLAMABAD: An accountability court in Islamabad on Tuesday morning directed authorities to auction former finance minister Ishaq Dar’s movable and immovable assets and seize his bank accounts.

    The decision came on an application filed by the National Accountability Bureau (NAB), seeking auction of Dar’s assets and asking the court to appoint a beneficiary of recovered amount.

    The court said that the provincial government will be responsible for auction. It empowered the provincial government to decide whether to sell or keep the seized assets.

    Judge Mohammad Bashir had reserved the verdict on the application on Monday after the anti-graft watchdog submitted details of Dar’s assets.

    The accountability court is hearing corruption reference filed by NAB against Dar, accusing him of accumulating assets beyond known sources of income.

    Red warrants issued to bring Dar back

    In the application filed by NAB’s prosecutor, Imran Shafique, under Section 99 of the Criminal Procedure Code (CrPC) and sub-sections (2) and (3), the accountability body maintained that Dar was arrayed as an accused but fled the country without facing trial and ignored multiple summons and arrest warrants. Shafique recalled that court issued a proclamation under Section 87 of the CrPC and directed the former finance minister to appear at a specified time but the orders were ignored, hence, Dar was proclaimed an offender.

    Verdict in Dar asset auction application reserved

    The application also stated that more than six months had passed but the accused had consciously refused to appear before the court. NAB’s counsel further claimed that the accused “faked an ailment”. “He has failed to justify his unavailability.”

    According to NAB, some of Dar’s properties were already attached by the court on November 2, 2017, while others remained beyond the jurisdiction of the court. Therefore, the bureau sought orders for attachment and appointment of a receiver.

    The application prayed to the court appoint a district officer to receive and deposit the amount in the treasury and for the state to take possession of Dar’s movable assets.

    His assets and accounts should have been seized the day he absconded from the country and clearly declared that he won't come back to face trial.

    That was the sole reason why him and NS's sons did not go to Pakistan even for the funeral of their mother.
