Merely imagining that the Nawaz family might be freed annoys me. Here I thought that we could finally forget about Nawaz playing a role in future politics.

Hopefully they stay in jail though.

RAWALPINDI: Captain (retd) Safdar's condition deteriorated at Adiala prison late Monday, sources said, after which the son-in-law of former premier Nawaz Sharif was being given medical attention inside the jail.

The sources informed that a decision to shift Safdar to hospital had yet to be made.

The son-in-law of the deposed prime minister was arrested by the National Accountability Bureau on July 8, following an accountability court's verdict in the Avenfield properties corruption reference in which Nawaz and his daughter were also sentenced.

The court had sentenced Nawaz to a total of 11 years in prison and slapped a Ł8 million fine (Rs1.3 billion) in the corruption reference while his daughter Maryam was sentenced to eight years with a Ł2 million fine (Rs335 million).

Nawaz's son-in-law was given a one-year sentence without any fine. He has since been serving his term at the Adiala prison.

On August 9, Safdar was shifted to the Pakistan Institute of Medical Sciences (PIMS), Islamabad from the prison after his condition worsened.

He had a stomach condition and his sugar level was also high, prison sources had informed Geo News.

ISLAMABAD: Former prime minister Nawaz Sharif, his daughter Maryam Nawaz and son-in-law retired Captain Mohammad Safdar will celebrate Eidul Azha in Adiala jail as the Islamabad High Court on Monday deferred its decision on petitions seeking their release.

This is the second time Mr Sharif will celebrate Eid in detention. Earlier, after the October 1999 coup, he was taken into custody and spent two Eids in detention.

Former prime minister Zulfikar Ali Bhutto was the first prime minister to have spent Eids in jail while being under arrest after the July 1977 coup.

Accountability court decides to simultaneously conclude remaining two references against ex-PM

An accountability court had on July 6 sentenced Mr Sharif to 10 years, Maryam to seven years and Capt Safdar to one year in prison in the Avenfield properties reference.

    Article continues after ad

An IHC division bench comprising Justice Athar Minallah and Justice Miangul Hassan Aurangzeb sustained an objection of the prosecution on maintainability of the petitions seeking suspension of the sentence awarded to the Sharifs.

National Accountability Bureau’s prosecutor Sardar Muzaffar Abbasi argued that after filing appeals against the conviction, the convicts could not file petitions for the suspension of the verdict.

Earlier, the court had ignored this objection and asked defence counsel Khawaja Haris and Amjad Pervaiz to advance their arguments. However, when the court had asked prosecutor Abbasi to argue the case on Thursday, he sought time for filing a reply. The bench had expressed annoyance over applying delaying tactics and subsequently imposed a fine of Rs10,000 on NAB and adjourned the hearing.

The court resumed the hearing on Monday and, after concluding the arguments, told Khawaja Haris that since the appeals against the conviction had already been fixed for hearing in the second week of this month, the decision on the Sharifs’ petitions might be deferred till then.

The IHC order read: “Section 32 of the National Accountability Ordinance (NAO), 1999 provides for a time frame for deciding the appeals. Since the learned division bench has directed fixing of the appeals, at this stage we are not inclined to decide these petitions and they shall remain pending and be fixed along with the appeals. In case, there is delay in deciding of the appeals then the petitioners shall be at liberty to press these petitions.”

The court directed the registrar office to fix the case immediately after the summer vacations scheduled to end by Sept 11.

Last week, the court had framed 10 questions for the prosecution to answer in order to get understanding about the case. The questions relate to the price of property, determination of known sources of income at the time of purchasing of the property, comparison of discrepancies, difference between benamidar and dependent, the law to evaluate trust deed, etc.

Interestingly, the prosecution’s arguments did not address these questions. During the course of hearing, prosecutor Abbasi read out previous orders of the Supreme Court issued in the Panama Papers case and selected excerpts of a report prepared by the Joint Investigation Team.

At one stage, Justice Aurangzeb had snubbed Mr Abbasi for reading out irrelevant text and regretted that latter had never pointed out even a single proposition during the entire arguments.

    Accountability court proceedings

Accountability court judge Mohammad Arshad Malik on Monday decided to conclude the remaining two references against Nawaz Sharif simultaneously.

The Islamabad police produced the former prime minister before the court.

During the course of arguments, Khawaja Haris, the counsel for Mr Sharif, said the Islamabad High Court had transferred the references to Judge Malik since accountability judge Mohmmad Bashir, instead of simultaneously deciding three references, concluded the Avenfield reference first.

Judge Malik summoned JIT head Wajid Zia for Aug 27 and adjourned the hearing

PML-N supporters booked for 'attempting to shower Nawaz with petals'

Two Pakistan Muslim League-Nawaz (PML-N) supporters who attempted to shower deposed premier Nawaz Sharif’s car with petals outside Central Jail, Rawalpindi were booked by police on Monday.

The duo were waiting outside the jail for Nawaz to exit in his car. Muhammad Afzal from Lahore and Muhammad Yasir from Gujranwala reached outside the high-security Rawalpindi jail carrying packs of rose petals, hoping to catch a glimpse of their leader.

Nawaz was departing from the prison to attend accountability proceedings in Islamabad. As the motorcade carrying Nawaz left the jail and came on road, the two men stepped forward trying to spot the vehicle Nawaz was in.
But before they could even glimpse the vehicle, the two were hurled into a police van and taken to a nearby Adiala police post. They were locked up and formally booked in a criminal case.

“With shopping bags containing rose petals in their hands, the two men entered the route despite police warning not to do so. They chanted slogans and interfered in official duty,” read the FIR registered against the two at the Saddar Berooni police station.

Sub-inspector Anwaarul Haq, on whose complaint the case was registered, said the two were arrested because they resisted police officials. “They tried to breach police cordon and also resisted officials. We will produce them before court today and seek their physical remand,” the officer said. He added there were only two PML-N supporters there at the time and they were arrested before they could approach the motorcade.

Authorities bar PML-N workers from meeting Nawaz, Maryam due to govt holidays

Pakistan Muslim League-Nawaz workers staged a protest outside Adiala Jail in Rawalpindi on Thursday after authorities declined their request to meet deposed prime minister Nawaz Sharif and daughter Maryam Nawaz – who are currently serving sentences handed down by an accountability court in Avenfield corruption reference.

According to Express News, officials cited that the visitors were barred due to government holidays. They added that the PML-N senior leaders has been informed of the development.

However, authorities had granted special permission to members of the Sharif family to meet Nawaz and Maryam on Wednesday – first day of Eid. Nawaz’s mother Shameel Akhtar, his brother and PML-N president Shehbaz Sharif and nephews Hamza and Suleiman were allowed to meet Nawaz and Maryam on the occasion of Eidul Azha.
Nawaz, Maryam decide to return for accountability court hearing

After almost 10 months of continuous trial, an accountability court found the former premier, his daughter Maryam and son in law Capt (retd) Safdar Awan guilty in one of the four corruption references filed by the National Accountability Bureau (NAB) in line with the apex court’s July 28, 2017 order and awarded them ‘rigorous imprisonment’ and heavy financial penalties.

In his verdict, Judge Muhammad Bashir sentenced Nawaz, Maryam and Capt (retd) Safdar 10, 7 and one year of rigorous imprisonment.

The accused were also disqualified to contest election or to hold public office for a period of 10 years to be reckoned from the date they are released after serving the sentence and they shall not be allowed to apply for or to be granted or allowed any financial facilities in the form of a loan for a period of 10 years from the date of their conviction within the meaning of section 15 of NAO 1999.

ISLAMABAD: An accountability court has sought yet another extension to conclude two pending references against ousted prime minister Nawaz Sharif.

Judge Mohammad Arshad Malik on Friday submitted a written request to the Supreme Court seeking the fifth extension in the trial of Mr Sharif.

Earlier on July 6, accountability judge Mohammad Bashir convicted Mr Sharif, his daughter Maryam Nawaz, and son-in-law retired Captain Mohammad Safdar in the Avenfield properties reference.

On July 28 last year, the Supreme Court while accepting the petition filed by Pakistan Tehreek-i-Insaf chairman Imran Khan and other political rivals of the Pakistan Muslim League-Nawaz leader had removed Mr Sharif from the office of prime minister and directed the National Accountability Bureau (NAB) to file three references against the Sharif family.

Accountability court is hearing Al-Azizia and Flagship Investment references filed by NAB

Subsequently, NAB in September that year filed three references — Avenfield properties, Al-Azizia and Flagship Investment — against the ex-premier.

Currently, Judge Bashir is conducting trial in the Al-Azizia and Flagship references. The Supreme Court has directed the accountability court to conclude the trial within six months.

Earlier in March, the apex court extended the timeframe of the trial proceedings till May then granted one month extension twice. After the conviction of Mr Sharif and his children, the apex court set another deadline of Aug 25 for the accountability court to conclude the pending references.

In the meantime, the Islamabad High Court (IHC) transferred the case to Justice Malik who has summoned star prosecution witness Wajid Zia on Aug 27 for cross-examination in the Al-Azizia case after which the court has scheduled to record his statement in the Flagship Investment reference.

The accountability judge Justice Mohammad Bashir had discarded the money trail of the Sharif family for Avenfield properties and held that these assets were beyond known sources of income. The court awarded Mr Sharif 10 years’, Maryam seven and Capt Safdar a year’s imprisonment. The same court, however, acquitted the ex-premier of the charge related to acquiring these assets through corrupt practices, illegal or dishonest means.

The Sharif family has challenged the conviction before the IHC. The bench — comprising Justice Athar Minallah and Justice Miangul Hassan Aurangzeb — has also heard the petitions seeking suspension of the sentence against Mr Sharif, Maryam Nawaz and Capt Safdar.

The bench after hearing the arguments from the defence counsel and the prosecution team observed that at the moment they were not inclined to pass any order and deferred the matter till hearing of appeal. However, the bench directed the registrar office to fix these appeals soon after the end of the summer vacation.

It may be mentioned that the summer vacation in the IHC started in July and would end on Sept 9. Hence, the appeals of the Sharif family are likely to be fixed in the week commencing from Sept 10.

The Supreme Court on Monday directed the accountability court in Islamabad to decide the Al Azizia and Flagship corruption references against the Sharif family within the next six weeks.

The court also directed Accountability Judge Mohammad Arshad Malik to submit a progress report of the case to the apex court on a weekly basis.

During a hearing of the application seeking an extension in the deadline, Chief Justice Saqib Nisar remarked that he hoped that the defence counsel would complete his defence within the stipulated time.

Khawaja Haris, who had asked the court to extend the time frame till December, said it would be difficult for him to manage if the Islamabad High Court (IHC) starts hearing his appeal against the verdict in the Avenfield flats case. To this, the chief justice responded that the defence counsel would have to work on Saturdays as well in such a situation, as judges are already doing so.

McDonald's fast food delivered to court during Nawaz Sharif's hearing

Deposed prime minister Nawaz Sharif was allegedly served McDonald’s for lunch during the Al-Azizia and Hill Metal Establishment reference case hearing on Thursday.

According to a private news channel, Pakistan Muslim League Nawaz (PML-N) leader Chaudhry Tanveer ordered the food upon Nawaz’s request.

Nawaz and other PML-N leaders including Javed Hashmi, Irfan Siddique, Mushahid Ullah Khan and Tanveer enjoyed their meal at the court premises.

It is pertinent to mention here that the accountability court judge had allowed the food to be brought inside the judicial complex.

SC rejects NAB reference against Sharif family

ISLAMABAD: The Supreme Court on Monday rejected a petition filed by the National Accountability Bureau against the Sharif family.

The anti-graft body challenged the Islamabad High Court's (IHC) decision to hear former prime minister Nawaz Sharif's plea for suspension of his sentence in the Avenfield case.

Imposing a Rs20,000 fine on the bureau, Chief Justice Mian Saqib Nisar noted that justice should be served to petitioners.

"Why does NAB file such baseless petitions," the chief justice remarked.

Admonishing NAB Prosecutor Akram Qureshi for challenging the IHC's decision, the chief justice said: "This is the [regular] mechanism. What is illegal in the high court's order?"

On September 15, the anti-graft body had moved the Supreme Court door in an effort to keep the IHC from ruling on an application from the Sharif family seeking the suspension of the Avenfield verdict.

Nawaz, his daughter Maryam, and son-in-law Captain (retired) Mohammad Safdar Awan had moved the IHC to suspend the verdict in the Avenfields properties reference after they were convicted by Accountability Court Judge Mohammad Bashir on July 6, 2018.

The accountability court had sentenced Nawaz to 10 years in prison, Maryam to seven years and handed a one-year sentence to Captain (retd) Safdar.

According to a petition submitted in court by NAB Chairman Javed Iqbal, the high court did not send NAB a notice before accepting the Sharif family's petition for hearing.

"The high court cannot rule on the Sharif family's petition without listening to NAB's perspective," the petition said.

Furthermore, the NAB chief said in his petition that ruling on the suspension application is not in the high court's jurisdiction and thus the IHC should be stopped from hearing the petition at all.

Panama verdict is getting exposed with everyday.

If non PCO judges Justice Athar Minallah & Justice Gul Aurangzeb heat Appeal than Accountability Court verdict would most probably be thrown in Dustbin.

This psycopath CJ, his allies Judge Bashir, Musharaf’s Crony Wajid Zia and ISI formed JIT had one aim and that was to disqualify Nawaz Sharif & Mariam Nawaz Sharif and put them behind bars on charges of corruption.

All this was done to undermine civilian supremacy in Pakistan and put forward selected Imran Khan Niazi subservient of GHQ.

May Allah grant health and long life to former 3 times prime minister of Pakistan Mian Muhammad Nawaz Sharif. Aameen. If he lives on than senseless Iqama judgment disqualifying NS would be overturned when real justice Qazi Faiz Essa will become CJ of Pakistan.

It's strange that this real 'judge' was the only one scared enough that he banned media from reporting and interpreting Hudaibiya Case. No other recent judgements were censored like this.

How many Zillion times you are going to open Hudaibiya Case to persecute Sharifs ??

How many times you are going to try Ishaq Dar and Sharifs for Ishaq’s statement given to ISI officer under Musharaf’s dictatorship for so called “ confessional statement “ under torchure ??

Supreme Court had already declared that the said statement is a peace of trash deserved to be dumped in Dust Bin.

You have zero evidence of Corruption against Sharifs. Face it now.

Read Azaz Syed’s column in Jang published couple of days ago where he mentions Imran Khan’s meetings with IB head twice where he later fired him for what ??

You cannot open Hudaibiya & Ittefaq Murda (dead bodies) numerous times to ridicule and persecute ppl’s representatives who didn’t accept demands of Establishment. There is no room for State within State.

There is no such statute of limitation on corruption cases in Pakistan, and please answer why this 'judge' was so scared of his judgment that he banned the media from even discussing it.
