    Candidates being interviewed for the post of FBR chief

    ISLAMABAD: The Imran Khan Administration is reportedly interviewing candidates for the post of Chairman Federal Board of Revenue (FBR) from the private sector to spearhead reforms in the tax administration and to broaden the tax base.

    Sources told Business Recorder Friday that Prime Minister Imran Khan has interviewed two to three men for the post including Ruhail Mohammed from Engro on the recommendation of Finance Minister Asad Umar.

    Sources in the Finance Ministry however expressed ignorance of any developments in the appointment of FBR Chairman from the private sector and added that so far the newly-appointed Finance Minister has not formally interacted with officials of the Finance Division on any matter, including economic issues.

    While talking exclusively to Business Recorder, former Federal Tax Ombudsman (FTO) Shoaib Suddle said the selection of FBR Chairman as well as other senior posts must be merit based subsequent to fair competition. Whether these posts are filled from private sector or public sector, their salaries must be market based to prevent any possibility of corruption in the discharge of their functions.

    The biggest problem demonstrated by the country’s tax machinery is through withholding tax refunds, collecting advance taxes and heavy reliance on withholding taxes in the sales tax mode. These practices have been ongoing for decades and have become more acute during the past 10 years which have badly damaged the economy and exports, former FTO said.

    Suddle noted that the FTO office was ready to issue authorization of warrants against big entities involved in tax evasion, but the FBR never showed any interest in proceeding against them.

    A leading tax expert suggested the Khan administration to immediately constitute a Fiscal/Tax Policy Board to formulate a viable tax policy for the FBR and restrict the functioning of the FBR to tax administration and revenue collection.

    The Fiscal or Tax Policy Board must separate tax policy from tax administration, and be headed by Finance Minister or Prime Minister and its members/experts should be from government and private sector including Secretary Finance and Chairman FBR, he added.

    Former Finance Minister Shaukat Tarin disclosed that annual revenue leakage of Rs 500 billion takes place due to corruption in the FBR. This figure has been increasing with time, tax experts told Business Recorder.

    This guy is a friend of my uncle back from his universities days (in Karachi). He says that he is an honest and capable guy, and would be a good choice.

    If they appoint him media will start crying that Asad Umar is bringing in his own people. However, if he is the best candidate he should be hired! Media is going to cry no matter what.

    Even PEDO chief Akbar Ayub Khan was apponted from Engro through Asad Umar He had to be removed by SC because of having no energy and power sector experince.

    In corporate world thats what happens. New CEO comes in, he brings his own direct reports who in turn bring their own. Very seldomly they keep the old guard.

    IRS and PCS officers are always saying no one else should be appointed to head FBR except them.
    They would not fully cooperate with past dmgs who were appointed as chairmen, now they will have to deal with a lateral entry.

    Anyone who has been in a position of responsibility will tell you when it comes to appointing someone at an important position or handing someone an important task one is tempted to opt for someone they knows well and feel they can trust. You can have the best of intentions in doing so but may end up disregarding merit. Where Asad Umer may be tempted to bring in someone he knows and trusts Imran may be tempted to go along with Asad who he knows and trusts. I hope Imran remains objective and selects the person most fit for the role whoever he may be.

    Tinkering with the FBR will make no difference, it needs a revolution.

    There is nothing wrong with recommendations when it is being done based on merit - it happens in the corporate sector across the world, in fact employees are encouraged by offering them commissions for referrals.

    The problem with Sifarish is when it is not done on merit but based on loyalty or friendship or some other factor.

    As an example, Imran Khan appointing Majid J Khan as PCB Chief would have been discredited as if he has done a favour for his cousin - but the fact of matter is there is probably no one better qualified for the job.

    FBR reforms to be discussed in next cabinet meeting

    ISLAMABAD: The government is gearing up to launch a drastic reform plan for the Federal Board of Revenue (FBR) with the objectives of enhancing revenue collection and promoting equity and transparency in the tax machinery.

    Dawn has learnt that the plan is in advanced stages, but nobody at the FBR is aware of it.

    “We have moved a summary to the cabinet for introducing reforms in the FBR” Finance Minister Asad Umar told Dawn on Monday. The cabinet is expected to take up the summary in its next meeting, he said. “I would describe this as the beginning of FBR reforms” he said. He added that the government intends to build on the work on the tax reform committee of the previous government, which had also been endorsed by a committee of the national assembly but never moved into implementation stage.

    He was unwilling to share further details on the reform measures saying the same will be shared in due time after cabinet’s approval. “I can tell you we will not be doing anything drastic, that would come out of nowhere” he tells Dawn.

    The move for reforms within the FBR is in line with the PTI manifesto, in which the party went so far as to commit to making it an autonomous body. Imran Khan in his first televised speech as prime minister pointed specifically at the FBR as the one government department in dire need of reform. “I will start with the FBR”, he promised in that televised address when discussing his plans for streamlining government machinery.

    However, confusion prevails as to the ownership of the summary being sent to the cabinet.

    Top officials in the FBR were surprised when contacted about reforms sent to cabinet for approval. “We are unaware of any such summary sent to the cabinet”, an official source in the FBR said. Such summaries are normally sent through the signature of secretary revenue division.

    Another source in the finance division also showed ignorance about any such summary. He said the division is aware of the new government move to introduce drastic reforms within the FBR, but did not know whether the summary has been sent or not.

    The source said it is possible that the restructuring summary was moved from the cabinet division. Normally, cabinet division deals with the restructuring, the source said.

    Several attempts have been made in past to reform the FBR and many studies conducted starting with the Qamarul Islam report in the mid 1980s, to the Shahid Husain Task Force in the late 1990s, the decade long Tax Administration Reform Project (TARP) and miscellaneous changes made as per agreement with the International Monetary Fund. All these efforts, however, have failed to bring about the desired deep-rooted change in the tax bureaucracy which remains stubbornly wedded to its way of doing things.

    Those familiar with the government’s plan tell Dawn that major thrust of the reform package is to separate revenue collection administration from tax policy formulation. The policy formation power will be taken away from FBR and handled separately.

    Many proposals are under consideration, whether to merge the tax policy formulation with the revenue division, create an independent entity, constitute a policy board or assign it to the relevant divisions. Currently, the revenue secretary is also serving as the chairman of FBR.

    FBR’s role will be confined only to tax administration and tax collection under the envisaged reform plan.

    Other proposed measures include enhancing the taxpayer cost of evasion, strengthening enforcement power of tax administration to go after non-compliant taxpayers, discouraging informal economy, cash transactions, and encouraging business through banks and enhance documentation, to ensuring across the board accountability of FBR workforce and non-compliant taxpayers.

    According to World Bank report on ease of doing business in Pakistan 2015, it takes 594 hours to pay taxes in Pakistan and out of 186 countries surveyed then, Pakistan ranked 172 in the level of difficulty in tax compliance.

    In the last World Bank-funded reform project, the government had created a separate Inland Revenue Services in 2009-10 by functional integration of income tax, sales tax and federal excise duty. Earlier, customs was responsible for collection of sales tax and federal excise. The model was adopted on the pattern of UK and India.

    You don't need to be a specialist in a particular subject area to head a department. Would you accept similar criticism of yourself once you eventually join the civil service?

    And I see you've decided against producing any evidence of his corruption. I guess it's like the evidence that's been produced which backs up the fact that the army made Imran Khan win.

    Funny this logic goes out the window when a journalist is made PCB head. Also you said Sethi isn't corrupt since NAB dismissed his cases, but this guy is corrupt because you say so?

    “Dr Jahanzeb Khan, another remarkable officer regarded as the pride of the erstwhile District Management Group (now renamed as the Pakistan Administrative Service), has been appointed as the Chairman of the Federal Board of Revenue (FBR).

    Jehanzeb long served under Shahbaz Sharif’s administration in Punjab. He started his career as an assistant commissioner in Punjab and laterserved as the deputy commissioner of Bannu and Abbotabad. Subsequently, he served as the Punjab’s Chairman of Planning and Development and the Additional Chief Secretary for Energy -- a post created by Shahbaz Sharif to tackle the previous power supply crisis. He also worked as secretary Health and secretary Livestock in the Punjab government. He also served as Pakistan's commercial counselor in Paris.

    Jehanzeb has been credited with the success of China Pakistan Economic Corridor projects in Punjab in his role as Chairman Planning. He has also served as Secretary Finance in Punjab and was the moving force behind the creation of the Punjab Revenue Authority.

    Although, he left his mark in Punjab, Jehanzeb actually belongs to Peshawar. He is business friendly and pro reforms, and perhaps for these reasons has been given the tough assignment of FBR Chairman. Government sources said that the FBR needs an outsider to shake it up. Imran Khan wants to double the present revenue to Rs8,000 billion within a couple of years. “Let’s see if JK (Jehanzeb Khan) can achieve this,” an official said.”
