ICC publishes edited version of spot-fixing ruling - Note Warning for UK Residents
The ICC has published on its website an edited and encrypted 102-page version of the final determination of the independent tribunal that handed out its verdict on February 5 after the spot-fixing hearings in Doha. However, in light of the Crown Prosecution Service's recent decision to pursue criminal charges against the three banned players - Salman Butt, Mohammad Amir and Mohammad Asif - the judgement will not be available to readers in England and Wales.
To others, the version available online (click here) is in a read-only format and will be available for a period of only seven days. "It is the ICC's intention to be as transparent an organisation as is feasible and to publish all its reports and findings for the benefit of stakeholders," ICC chief Haroon Lorgat said. "Publishing the full written determination of the tribunal is clearly in the best interest of cricket." The tribunal, too, had recommended a full disclosure However, their hands have been forced by legal considerations. The determination came with a clear warning, prohibiting the publication or dissemination of the determination within England and Wales. Guys - this is a legal matter so be VERY VERY careful. There are all sorts of ways to tracing this doc to you including asking us to disclose your IP address etc - I dont think its worth the risk.
As someone living outside the UK, I have seen the document and its interesting reading - but nothing like Wikileaks etc ! All will come out in public domain soon.

Just a warning to all - If you are in the UK and access this document then you are liable for a contempt of court.
The determination came with a clear warning, prohibiting the publication or dissemination of the determination within England and Wales. It also laid out that any attempt to access it from within England and Wales would be deemed unlawful, and could invite legal action.

ICC publishes final determination of independent Anti-Corruption Tribunal The International Cricket Council (ICC) has this evening published a redacted and encrypted version of the final determination of the independent Anti-Corruption Tribunal following the hearing into spot-fixing charges against three Pakistan players – Salman Butt, Mohammad Amir and Mohammad Asif – which concluded in Doha, Qatar on 5 February 2011. When handing down its decision, the tribunal expressed the strong view that its full written determination should be published widely (as the ICC has the power to do under the ICC Anti-Corruption Code), so that interested parties can read and fully understand the reasons for the tribunal’s determination. The ICC shares that view and wishes all stakeholders and followers of the sport to see for themselves the effort and resource that the ICC has devoted to pursuing these charges, so that there can be confidence in the ability of the ICC (and its Anti-Corruption and Security Unit) to defend and maintain the reputation and integrity of the sport from corrupt activities. Haroon Lorgat, the ICC Chief Executive, said: “It is the ICC’s intention to be as transparent an organisation as is feasible and to publish all its reports and findings for the benefit of stakeholders. Publishing the full written determination of the tribunal is clearly in the best interest of cricket.” However, in light of a recent decision by the UK Crown Prosecution Service (CPS) to pursue criminal charges against the three players, the ICC has taken steps to permit read-only and non-printable access to a redacted version of the tribunal’s full written determination via its website for the next seven days only (i.e. until Wednesday 16 February) and to those users located outside of England and Wales only. WARNING: Anyone located inside of England and Wales is prohibited from accessing this determination. Accessing or attempting to access the determination in violation of this prohibition would be a breach of the terms and conditions of this website and therefore unlawful. Any publication or dissemination of the determination within England and Wales is subject to the strict legal restrictions set out in the Contempt of Court Act 1981.

I think we all need to be careful what we post here - its upto our own judgement.
Looks to me that in the case court, evidence will be presented afresh and the ICC proceedings will not be taken into account - which is why they dont want any potential jurors to read this.

If ICC makes it easy to read it (by not having strong safeguards) do the lawyers have an argument to exclude some of the evidence.
I think ICC if not very clever will give the players a backdoor to save themselves on some technicality. I for one don't want them to be charged in England. In Pakistan of course but as much damage they (the trio) have done already we should wash our dirty laundry in house. |
